[Legal entity not yet incorporated — update with entity name, registration jurisdiction, and registered address once formed] ("we", "us") operates Lancong (the "App"), a trip-planning and group-expense tool.
You must be at least 13 years old to create an account. If you are under the age of majority in your jurisdiction, you may only use the App with the involvement of a parent or legal guardian. [Confirm minimum age against Malaysia PDPA and any other jurisdiction-specific minors' consent requirements]
You agree not to use the App to: violate any law; harass, abuse, or harm another user; upload malicious files; attempt to bypass rate limits, authentication, or access controls; or scrape/automate access beyond normal use.
You're responsible for keeping your login credentials secure. Guest accounts have reduced functionality (no saved photos/receipts, no comments, no ratings) and are not tied to a persistent identity.
You retain ownership of the trip data, photos, and comments you upload. By uploading content, you grant us a license to store, process, and display it back to you and the trip members/friends/public audience you configure via the app's sharing settings, including through the third-party infrastructure providers listed in the Privacy Policy that we use to operate the App (e.g. hosting, storage, backups). This license ends when you delete the content or your account, except where a copy persists in routine backups for a limited period.
We may suspend or terminate your access to the App, in whole or in part, if we reasonably believe you have violated Section 3 (Acceptable use) or these terms, or to comply with law. Where practical, we will provide notice and the reason. You may stop using the App and request deletion of your account at any time as described in the Privacy Policy.
The App relies on third-party infrastructure to function — see the Privacy Policy's "Third-party processors" section for the current list.
The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except to the extent such warranties cannot be excluded under applicable law. We do not guarantee the accuracy of AI-generated itinerary suggestions, exchange rates, or geocoded locations — always verify travel-critical information (visa requirements, safety advisories, exact addresses) independently.
To the maximum extent permitted by applicable law, our total liability arising out of or relating to the App will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) RM100. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or travel-related losses (e.g. missed flights, cancelled bookings, visa denials), even if advised of the possibility of such damages. Nothing in these terms limits liability that cannot be limited under applicable law, including liability for fraud or death or personal injury caused by negligence.
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the App, your uploaded content, or your violation of these terms or applicable law.
These terms are governed by the laws of [Malaysia — confirm once operating entity's jurisdiction is finalized], without regard to conflict-of-law principles. Any dispute arising out of or relating to these terms or the App will be subject to the exclusive jurisdiction of the courts of [same jurisdiction — confirm], except where applicable consumer-protection law grants you the right to bring a claim in your local courts.
If any provision of these terms is found unenforceable, the remaining provisions stay in effect. These terms, together with the Privacy Policy, are the entire agreement between you and us regarding the App. We may assign these terms in connection with a merger, acquisition, or sale of assets; you may not assign your rights under these terms without our consent.
We may update these terms. Continued use of the App after an update means you accept the revised terms.
